Abstract


This article examines the correlation of the notions “validity of proceeding decisions” and “sufficiency of evidence” used in the criminal procedure legislation of the RF. The process of formulation of grounded proceeding decisions is reviewed from the perspective of the sufficiency of the evidence held by a subject of proof. It is shown that the extent of the evidence necessary to formulate а grounded proceeding decision depends on а stage of criminal proceedings, a phase of the proceedings at the stage and the essence of a certain formulated decision.
